  Third party funding for arbitration: practical opportunities and challenges for construction disputes

This presentation will be given by Julian Cohen MA (Oxon), FCIArb, Barrister and Arbitrator, Gilt Chambers, Hong Kong.

Julian’s talk will consider how, and to what extent, third party funding of arbitration is likely to affect domestic and international construction disputes in Hong Kong. He will consider some of the unique features of construction disputes (in contrast to many other commercial disputes) and consider whether these present
opportunities or obstacles for third party funding to take off. The talk will also look at some of the challenges that are likely to arise in third party funded arbitrations, and identify practical issues that will need to be addressed by parties, funders and arbitrators. These issues will include the management of proceedings as well
as liability and enforcement of cost orders and awards.
